Terms of Service

Welcome to Ace of CrØwns, also known as The Crowned Court — a
graphic design portfolio and commission inquiry website. These Terms of Service ("Terms") govern your use of the contact
form on this website. Please read them before submitting a message.
1. Acceptance of Terms
By submitting the contact form on this website — whether for a commission inquiry, a general
message, or any other purpose — you acknowledge that you have read, understood, and agree to be
bound by these Terms. This agreement is formed electronically and is valid and enforceable under
the Electronic Commerce Act, 2000, S.O. 2000, c. 17 (Ontario) and applicable Canadian
federal law.
If you do not agree to these Terms, please do not submit the contact form.
2. Who May Use the Contact Form
The contact form is open to anyone who wishes to make a genuine commission inquiry or send a respectful message. You represent that:
- The information you provide is accurate and not misleading;
- You are submitting the form for a lawful purpose;
- You have the legal capacity to enter into agreements in your jurisdiction.
3. Acceptable Use Policy
You agree to use the contact form only for legitimate, respectful communication. You must not submit messages that:
- Are abusive, hostile, threatening, intimidating, or harassing in nature;
- Contain hate speech or discriminatory language targeting any individual or group;
- Constitute spam or unsolicited commercial messages contrary to Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23;
- Include malicious code, phishing content, or attempts to exploit the website;
- Impersonate another person or entity;
- Are otherwise unlawful under Ontario or Canadian federal law.
4. Prohibition on Hostile, Threatening, or Harassing Messages
Ace of CrØwns has a strict zero-tolerance policy toward hostile, threatening, or harassing
communications. This is a creative space, and the artist operating this website is entitled to
engage with the public free from intimidation.
Specifically, messages that constitute harassment may expose you to civil liability under
Ontario's tort law, including the tort of harassment as recognized in Ontario courts. Messages
containing threats — including threats of harm, property damage, or reputational damage — may
constitute a criminal offence under sections 264 (criminal harassment) and 264.1 (uttering
threats) of the Criminal Code of Canada, R.S.C. 1985, c. C-46.
If you send a hostile, threatening, or harassing message through this contact form, the artist reserves the right to:
- Retain a record of your message and associated technical data (including IP address);
- Report the communication to appropriate law enforcement authorities;
- Pursue civil legal action in the courts of Ontario for any damages caused;
- Seek injunctive or other equitable relief as appropriate.
Be kind. This really shouldn't need to be in here, but here we are.
5. Commission Terms
Submitting a commission inquiry through the contact form does not create a binding contract or guarantee acceptance of your commission request. The following applies to all commission inquiries:
- No obligation to accept: The artist reserves the absolute right to decline any commission request at their sole discretion, for any reason or no reason, without obligation to provide an explanation.
- Creative rights: Unless otherwise agreed upon in a separate, written commission agreement signed by the artist, the artist retains all creative rights, moral rights, and intellectual property rights in any artwork produced. Any transfer or licence of rights must be explicitly stated in writing.
- Deposits and payment: Specific payment terms, deposit amounts, timelines, and deliverables are subject to a separate written agreement reached between you and the artist prior to commencement of any work. Nothing in these Terms constitutes a payment obligation on either party.
- Revisions and scope: The scope of revisions, turnaround times, and file formats will be defined in any commission agreement. The contact form is an inquiry tool only.
6. Intellectual Property
All artwork, designs, logos, and visual content displayed on this website are the intellectual
property of the artist operating Ace of CrØwns and are protected under the Copyright Act,
R.S.C. 1985, c. C-42 (Canada). Nothing on this website grants you any licence or right to use,
reproduce, distribute, or modify any content without express written permission from the artist.
The name "Ace of CrØwns" and "The Crowned Court", along with any associated branding, are the artist's intellectual property. Unauthorized use is prohibited.
7. No Spam or Unsolicited Commercial Messages
In accordance with CASL, you agree not to use the contact form to send commercial electronic messages without the express or implied consent of the recipient. The contact form exists so that you can reach the artist — not so that you can solicit them.
8. Limitation of Liability
This website and its contact form are provided on an "as is" basis. The artist makes no warranties, express or implied, regarding the availability, accuracy, or fitness of this website for any particular purpose.
To the fullest extent permitted by Ontario law, the artist shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the contact form. The artist's total liability for any claim arising under these Terms shall not exceed CAD $0, as the contact form is provided as a free communication service.
Nothing in this clause limits liability for fraud, intentional misconduct, or any liability that cannot be excluded by law in Ontario.
9. Privacy
Information you submit through the contact form is collected and handled in accordance with the Privacy Policy for this website, which is incorporated into these Terms by reference. Please review the Privacy Policy before submitting a message.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the contact form shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
11. Dispute Resolution
The artist prefers to resolve disputes informally whenever possible. If you have a concern, you are encouraged to contact the artist directly in good faith before initiating formal proceedings.
If an informal resolution cannot be reached within 30 days of written notice of a dispute, either party may pursue their rights and remedies through the courts of Ontario. Nothing in this clause prevents the artist from seeking urgent interim or injunctive relief from a court at any time.
12. Changes to These Terms
The artist may update these Terms from time to time. Any changes will be reflected by an updated effective date at the top of this document. Continued use of the contact form after any changes constitutes acceptance of the revised Terms.
